The purpose of these General Terms and Conditions (hereinafter referred to as GTC) is to fully regulate the rights and obligations of the User (hereinafter referred to as User) using the "Basic", "Pro" and "Agency" services (hereinafter referred to as Services), provided through the "Infinite∞Ad" website (https://infinite.ad hereinafter referred to as website or web page) by Infinite AD Limited Liability Company (Registered office: 1026 Budapest, Pasaréti út 122-124., Company registration number: 01-09-412791, Tax number: 32222632-2-42 hereinafter referred to as Service Provider), as well as the general terms and conditions and the manner of using the services of the website.

1. General Provisions

1.1 The User may use the website and the Service provided, following registration, under the condition of acceptance of the present GTC and in accordance with its provisions.

1.2. By registering on the website, the User simultaneously accepts the contractual terms and conditions determined by the present GTC, agrees with all its provisions, and acknowledges them as binding upon themselves. If the User does not accept the provisions of the present GTC during registration, and does not declare acknowledgment of and consent to the Data Privacy Notice, they are not entitled to use the website, and thereby access to the Services.

1.3 The language of the contract concluded between the User and the Service Provider on the website by accepting the present GTC, and by ordering or purchasing any of the Services by the User, is Hungarian. The contract is concluded electronically but is considered a non-written contract, the content of which is registered and archived by the Service Provider exclusively electronically, ensuring that the contract can be accessed and retrieved retrospectively.

The Service Provider informs the User that the Service Provider does not submit to any behavior code provisions.

1.4. The website works with all known browser software and operating systems. Communication on the website is conducted through the HTTPS protocol. Communication via the website is encrypted. The security of the website is at an adequate level, its use does not pose a risk to its users, however, the Service Provider advises Users to take the following precautions: use software providing protection against viruses and spyware, and always install security updates offered by the operating system they use. Purchasing on the website implies that the User understands and accepts the limitations and potential errors of internet technology.

2. Scope of the GTC

2.1 The present GTC applies to all legal transactions and services realized through the website and provided by the Service Provider on the website to the User.

2.2. The territorial scope of this GTC includes transaction between the Service Provider and the User concluded within the territory of Hungary. The legal relationship of the Parties is governed by Hungarian law.

2.3 The present GTC completely and automatically regulates the terms of the legal relationship established between the Service Provider and the User.

2.4 The present GTC becomes effective on the day of its publication, with respect to the User, it becomes mandatory upon acceptance of the GTC during registration. The GTC loses its effect upon withdrawal or modification by the Service Provider, with respect to the modified provisions.

3. Modification and publication of the GTC

3.1 The Service Provider publishes the current text of the GTC on the website and ensures its continuous availability for the User. The Service Provider ensures that the GTC can be easily downloaded by the User from the website interface.

3.2. The Service Provider is obliged to post the text of the modified GTC on the website - indicating the provisions affected by the modification and the date of entry into force of the modification - at the latest simultaneously with the entry into force of the modification. The modification must be disclosed in such a way - even in a consolidated format - that the fact of the modification, its date of entry into force, as well as the range of provisions affected by the modification can be clearly established by the User. The User is obligated to learn about and accept the modifications of the GTC for the further use of the website, which the Service Provider enables electronically on the website with a pop-up window upon login after the modification.

4. Definitions used in the GTC

4.1. service provider: who provides Services to the User

4.2. user: the natural person or legal entity who avails of the Service as per the conditions set forth in the present GTC.

4.3 Service: The service is a tool connected to the Meta system, through which the connected partner can initiate and manage advertisements in the Meta system without human intervention via the Infinite∞Ad system, and can also review, evaluate, and generate new post texts on Facebook and Instagram using AI. The Service can be purchased exclusively online, by selecting and paying for the service advertised by the Service Provider. Services can be tested free of charge by the User.

4.4. Services available to Users are accessible via a monthly subscription, which is valid for 1 month, hence the monthly period expires on the corresponding day of the following month as the order day; if this day is missing in the expiration month, it expires on the last day of the month, and the subscription automatically renews unless the User cancels it by the 5th day before its expiration.

4.5 Consumer: the natural person who acts outside the scope of their profession, independent occupation, or business activity in purchasing a Service falling under the scope of the present GTC, as well as in contracts for utilizing the Service.

5. Availing of the Service

5.1 The use of Service provided on the website and ordering of Service is possible exclusively electronically, following registration on the website, in the ways specified in the present GTC. Registration on the website is free.

5.2 Registration method: for the purpose of availing the Services on the website, the User can start their registration by clicking the "My Account" button, by pressing the "Sign Up" button. Subsequently, on the data sheet, the email contact, phone number, first name, last name, and company name, if any, must be provided, and by clicking on the "Register" button, the registration is approved via email and access is gained to the application.

5.3 Throughout the entire registration process until its completion, the Service Provider ensures appropriate technical tools so that the User can identify and correct data entry errors before finalizing registration. The Service Provider draws attention to the fact that if the User does not or provides incomplete data during the registration on the website, then - due to the lack of basic information necessary for providing the Service - the User's request for profile registration is not obligatory for the Service Provider, and the Service Provider is not obliged to provide it.

5.4 The Service Provider sends confirmation to the provided email address about the success of the registration within 1 minute following the click on the link in point 5.2., redirecting for review to the website.

5.5 The Service Provider bears no responsibility in case the confirmation, or any other subsequent email notification fails to arrive, due to the User's inaccurate provision of the email address, or due to the mailbox being full, rendering it undeliverable.

5.6 The User is entitled to delete their registration in their account. By selecting the Account option in the left-side menu upon logging into the account, the user arrives at their account data, where they can delete their account with the delete button at the bottom of the page.

6. Using the Service

6.1 The User connects their Facebook profile to the Infinite∞Ad system and grants permission for the Infinite∞Ad Facebook app (which is an authenticated technology provider in Meta system, identifier: 785636805762703) to access Facebook pages, Instagram accounts, and ad accounts managed by the User that connect to a business account.

6.2 Subsequently, the User adds those accounts which they wish to manage within the Infinite∞Ad system.

6.3 The User sets up the advertisement initiation and management rules based on which Infinite∞Ad manages the advertisements in Meta advertising system.

6.4 Once the User links their user account in the Connected Platforms menu, using the Meta Business / Connect profile button at the top right corner, usage begins and the 7-day trial period starts.

6.5 The User has the option with the aid of AI to analyse the text of their posts, as well as to have yet-to-be-posted content texts checked, and to request new variations.

6.6. Following registration, the User can activate their registration by clicking on the confirmation link sent to the provided email address, and afterwards, they can log in to avail the Service by clicking the "My Account" button on the website.

7. Purchasing the Service

7.1 The Service can only be purchased online through the website.

7.2 If any questions arise for the User concerning the Services, they are entitled to contact the Service Provider via the email hello@infinite.ad, or through the customer service chat located on the bottom right corner of the page.

7.3. If the User notices that their data necessary for the completion of the purchase (billing) was provided incorrectly after the purchase, they can report the error, as well as the correct data to the Service Provider in writing within 5 (five) working days following the sending of the purchase, via a message sent to the hello@infinite.ad email address.

7.4. The prices of Services offered on the website are indicated in EUR. The consideration for orderable Services is subject to value-added tax and other public charges.

7.5 Following the debit card provision, the service provider issues a monthly invoice to the User, which can be accessed in their account, and is also sent via email.

7.6 The Service Provider reserves the right to modify any time the range of Services purchasable on the website as well as their prices. The Service Provider declares that price changes do not adversely affect the purchased Services' sales prices.

7.7. If an incorrect price appears on the website's interface despite the Service Provider's utmost care, particularly regarding obviously erroneous, significantly deviating from the product's generally accepted price due to possible system error appearing as "0" EUR or "1" EUR, then the Service Provider is not obliged to deliver the Service at the incorrectly indicated price but may offer the Service at the correct price, in the knowledge of which the User may decide to withdraw their intention to purchase.

8. Service Cancellation and Package Change

8.1 Monthly subscription: the service can be cancelled or modified at any time within the user's account.

8.2 In case of cancellation, the service remains accessible until the month's end, and will not renew the following month.

8.3 In case of modification, if the User upgrades to a higher package, the difference will be charged immediately, and the higher-level services will become accessible at once. If switching to a lower package, the change takes effect in the next billing cycle.

9. Trial Period and Money-Back Guarantee

9.1 All new Users are entitled to a 7-day free trial period.

9.2. All features of Infinite∞Ad are available without restriction during the trial period.

9.3 After the trial period expires, if the User does not cancel the service, the paid period automatically begins.

9.4. The Service Provider provides a 30-day money-back guarantee. If the User is dissatisfied with the service within 30 days following the first payment, they may request their paid amount to be refunded via a written request to the hello@infinite.ad email address. The refund will be processed within 14 days following receipt of the request.

10. Payment Process

10.1 The User can provide their billing and payment details in the Billing and Payment submenu under the Settings menu on the profile page.

10.2 Here, the User may select the desired service package (Basic, Pro, Agency), as well as decide on availing the managed account service. The managed account service is available exclusively with the Basic and Pro packages.

10.3 The first payment occurs automatically based on the provided bank card details following the expiration of the trial period. If the User does not provide valid bank card details by the end of the trial period, the Service cannot be continued in the paid period. In such a case, the User's account enters inactive status, but their data remains preserved for 30 days during which time the introduction of payments data can reactivate their account.

10.4 Payments are processed via the Stripe platform. The User acknowledges that their payment data is managed by Stripe in accordance with its own privacy policy.

11. Billing

11.1 The Service Provider issues an electronic invoice to the User after each successful payment.

11.2 The electronic invoice is issued through the Billingo system.

11.3 The invoice is available in the User's account under the Payment History submenu in the Settings menu, and also sent via email to the email address provided by the User.

12. Handling user complaints

12.1 If the User has any complaints arising during their purchase or after using the service, they are entitled to submit it to the Service Provider.

12.2 Complaints can be submitted in electronic message form to hello@infinite.ad or by mail to the above mailing address. Upon receipt of the written complaint, the Service Provider will promptly but no later than within thirty (30) days from receipt, investigate the content, and inform the User of the result of the investigation and, in the event of rejection, what legal remedies are available to the User.

13. Liability Rules

13.1. The User undertakes to acknowledge the provisions of the present GTC and the information published on the website operated by the Service Provider as binding upon themselves concerning the operation of the website and the purchase of Packages and the utilization of the Service and acts to perform their obligations contractually as generally expected in the given situation.

13.2 The Service Provider declares that the Infinite∞Ad platform is a tool for which appropriate use is the User's responsibility. The Service Provider assumes no responsibility for the content, performance, or possible consequences of the advertisements created by the User through the use of the Service. The User is solely responsible for the content displayed within the scope of the Service, including advertisement text, images, and other elements. The Service Provider bears no responsibility for the content uploaded or created by the User.

13.3 The Service Provider does not assume responsibility for any potential financial losses or gains resulting from the use of the Service. It is the User's responsibility to use the Service in alignment with their business goals, prudently.

13.4 The Service Provider does its best for the continuous and error-free operation of the Service, but does not guarantee that the Service will always work without interruption or error. The Service Provider assumes no responsibility for any damages or loss of profit resulting from possible technical problems or outages of the Service.

13.5 The Service Provider undertakes not to use data derived from social media accounts or other associated accounts of clients integrated into the system by agencies beyond the extent necessary to provide the service. The Service Provider neither approaches these clients with direct business offers nor uses this information for its own marketing or sales purposes. In agency-integrated accounts, the Service Provider undertakes not to engage in direct business acquisition activities and treats the acquired data confidentially.

14. Copyrights

14.1 The "Infinite∞Ad system" is protected under copyright law. The Service Provider is either the copyright holder or authorized user of all content presented during the provision of services available through the website.

14.2. Use of the website content is only possible with the prior written consent of the Service Provider.

15. Data Protection

15.1 The Service Provider handles the User's personal data in accordance with the provisions of the Data Privacy Notice.

15.2 The Data Privacy Notice is available on the website and the User is required to accept it during registration.

15.3. The Service Provider declares that it handles the User's personal data in accordance with the provisions of the GDPR and Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information.

16. Conciliation Boards and Other Remedies

16.1 If the Service Provider rejects the consumer's complaint, the consumer may apply to the Conciliation Board competent for their place of residence or stay: the condition for initiating the conciliation board procedure is that the consumer tries to resolve the disputed matter directly with the Service Provider.

16.4 The conciliation board procedure is initiated upon the consumer's request. The request must be submitted in writing to the chairman of the conciliation board.

16.5 The User may also contact the European Online Dispute Resolution Forum to handle their complaint against the Service Provider. 16.6. The User is entitled to enforce their claim arising from the consumer dispute before the court in civil proceedings as per the provisions of Act V of 2013 on the Civil Code and Act CXXX of 2016 on Civil Procedure.

16.7 Consumers are entitled to submit a complaint to the consumer protection authority competent for their residence. After evaluating the complaint, the authority decides on conducting the consumer protection procedure. The consumer protection authority's contact information can be found on http://www.kormanyhivatal.hu/hu.

17. Final Provisions

17.1 In matters not regulated by the present GTC, the provisions of Act V of 2013 on the Civil Code, Act CVIII of 2001 on certain issues of electronic commerce services, and the information society services, as well as the provisions of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, are applicable.

This GTC is valid from September 16, 2023, until withdrawal.
